Terms of Service

By using Skiftly (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
Skiftly is operated by the company identified on the Legal Noticepage ("Skiftly", "we", "us").
2. Your account
- You must be at least 16 years old to create an account.
- You are responsible for keeping your login credentials safe. Do not share them.
- You must provide accurate information and keep it up to date.
- If you create a team on behalf of an organisation, you confirm you are authorised to do so.
3. Acceptable use
You agree not to:
- Break any applicable law, or infringe anyone's rights.
- Try to access accounts, teams, or data that are not yours.
- Reverse engineer, scrape, or automate the Service in a way that harms availability.
- Upload content that is illegal, harassing, hateful, or that infringes intellectual property.
- Use the Service to send spam or unsolicited messages.
4. Team data and admin responsibilities
- Team admins control who is invited, what leave types exist, and how balances are tracked.
- Admins are the data controllers for their team's planning data under GDPR. Skiftly acts as processor for that data.
- Admins are responsible for ensuring they have a lawful basis to invite and store data about their team members.
5. Plans and billing
- Skiftly offers a Free plan for small teams and paid plans (Growth, Enterprise) with additional features.
- Paid subscriptions are billed monthly or annually in advance in EUR.
- Prices exclude VAT, which is added at checkout for EU customers where applicable.
- You can cancel a paid subscription at any time. Access continues until the end of the paid period; we do not refund the unused portion.
- We may change prices with at least 30 days notice for existing customers.
6. Uptime and availability
We aim to keep the Service available 24/7 but do not guarantee uninterrupted operation. Scheduled maintenance and third-party outages may cause downtime. The Service is provided "as is" without warranties beyond what applicable law requires.
7. Data ownership and privacy
- You own your data. We only use it to provide the Service, as described in our Privacy Policy.
- You can export your calendar via iCal and delete your account from Settings at any time.
8. Intellectual property
Skiftly, its logo, source code, and design are owned by us. You get a limited, non-exclusive, non-transferable licence to use the Service. You keep ownership of anything you upload.
9. Termination
- You may stop using and delete your account at any time.
- We may suspend or terminate an account that materially breaches these Terms, with reasonable notice where possible.
- On termination, we delete your personal data within 30 days, except where retention is legally required (for example, tax records).
10. Liability
To the fullest extent allowed by law, our aggregate liability under these Terms is limited to the amount you paid Skiftly in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss beyond what the Privacy Policy commits to.
Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded under Belgian law.
11. Changes to these Terms
We may update these Terms. If a change materially affects you, we will notify you at least 30 days before it takes effect by email and by an in-app banner. Continued use of the Service after the effective date means you accept the new Terms.
12. Governing law
These Terms are governed by Belgian law. Any dispute is subject to the exclusive jurisdiction of the courts of Brussels, Belgium, except where mandatory consumer protection rules assign jurisdiction elsewhere.
